Law 4990/2022

1. What is this about?

It incorporates into the Greek legislation the development of a comprehensive framework for the protection of persons reporting issues of breaches of Union Law, as set out by the European Directive (EU) 2019/1937 on Whistleblowing (whistleblowers).

2. Which entities are considered obliged entities according to L. 4990/2022?

• Legal entities in the private sector with 50 to 249 employees have the obligation of implementing the law until 17 December 2023
• Legal entities in the private sector with more than 249 employees, or engaged in financial services, products and markets or in activities that may pose a risk to the environment or public health or that operate on the basis of a decision approving environmental conditions, have the obligation of implementing the law until 12 May 2023
• Public law legal entities (Local Authorities) have the obligation of implementing the law until 12 May 2023.

3. What are the obligations of legal entities according to L. 4990/2022?

• Development of an internal and external breach reporting system
• Appointment of an Officer for Receipt and Monitoring of Reports (O.R.M.R.) and notification to the Hellenic Labour Inspectorate within two months of their appointment. For legal entities in the private sector with fewer than 50 employees, it is not mandatory.
• Obligation to protect the persons making a report
• Obligation to ensure confidentiality
• Establishment of a mechanism for receiving and processing the report and decisions taken on the reports received
• Investigation-Investigation Team
• Keeping of Records and Reports
